1. Acceptance of Terms
By accessing or using DataSafeVault's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Description of Services
DataSafeVault provides automated cloud backup, data protection, and disaster recovery services. Our services include encrypted backup storage, scheduled backups, point-in-time recovery, and multi-region data replication.
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Ensuring your backup configurations are correctly set up
- Maintaining custody of your encryption keys
4. Data Ownership
You retain all ownership rights to your data. DataSafeVault does not claim any ownership over the data you store using our services. We will not access, use, or share your backup data except as necessary to provide the service or as required by law.
5. Service Availability
We strive to maintain 99.99% uptime for our backup and recovery services. Planned maintenance windows will be communicated in advance. We are not liable for service interruptions caused by factors beyond our reasonable control.
6. Payment Terms
Paid plans are billed monthly or annually as selected. Payments are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Storage overages will be billed at the published overage rate.
7. Acceptable Use
You agree not to use our services to:
- Store or transmit illegal content
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service for other users
- Use the service for cryptocurrency mining or computation
8. Data Deletion
Upon account termination, your backup data will be permanently deleted within 30 days. You may request an export of your data before closing your account. Once deleted, data cannot be recovered.
9. Limitation of Liability
DataSafeVault's total liability for any claim arising from these terms or our services shall not exceed the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Indemnification
You agree to indemnify and hold DataSafeVault harmless from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.
11. Modifications
We may update these terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts located in Delaware.
